Digitalisation in IP and Future Perspectives

From my experience working in international intellectual property roles, digitalisation has already had a major impact on how IP work is carried out. Many processes that were previously manual, fragmented, and time-consuming are now managed through digital systems. IP databases, online filing platforms, and portfolio management tools have significantly improved how trademarks and designs are filed, renewed, monitored, and reported on across multiple jurisdictions.

Digital tools have already made it possible to manage large IP portfolios more efficiently, improve milestone tracking, and produce higher-quality internal reporting. Working with IP offices, external lawyers, and international partners across different countries is now mostly done through digital platforms, which has improved communication, coordination, and compliance with rules. Automation also lowered the chance of human mistakes, especially when handling renewals, official record updates, and deadline tracking. As a result, IP professionals can spend less time on repetitive administrative work and focus more on strategic thinking, analysis, and giving expert advice.

Looking ahead, artificial intelligence and automation are expected to play an even bigger role in areas such as IP searches, document review, compliance checks, and portfolio analysis. While many of these tools are already in use, their capabilities are likely to continue developing. As digitalisation progresses, ways of working will become more flexible, and IP professionals will increasingly need to understand not only legal frameworks, but also the digital systems and technologies that support new ideas and innovation.

Risks of an Open Digital Society and the Role of GDPR

Digitalisation offers clear benefits in terms of efficiency and access to information, but it also raises important ethical and societal concerns. In a data-driven society, decisions are increasingly influenced by automated systems and algorithms that often lack transparency. This can create power imbalances between individuals and organisations, particularly where users have limited understanding of how their personal data is processed or how automated decisions are made.

These concerns are especially relevant in intellectual property and legal services, where fairness, accountability, and trust are essential. While digital tools can improve access to legal information and streamline decision-making, they may also reinforce existing inequalities if access to technology or digital literacy is uneven. In addition, excessive reliance on automated systems risks reducing critical human judgement if appropriate safeguards and oversight are not maintained.

An open digital society therefore requires more than technological innovation alone. It also depends on ethical awareness, professional responsibility, and effective legal regulation. Principles such as transparency, explainability, and human oversight must remain central when adopting digital technologies, ensuring that efficiency gains do not come at the expense of fundamental rights.

In this sense, GDPR represents an important effort to rebalance power and encourage more responsible data handling by strengthening individual rights and placing clearer obligations on organisations. From a personal perspective, it has made me more aware of how my data is collected, stored, and used, while also giving me greater control over consent and marketing communications. As a result, I have become more conscious and critical in how I use digital services.

Professionally, data protection is now embedded in everyday tasks, such as accessing databases, handling personal data in IP filings, and managing internal documentation. However, compliance can be resource-intensive, particularly for smaller organisations, and its complexity can create uncertainty in cross-border and technology-driven contexts. Balancing innovation with regulatory compliance therefore remains an ongoing challenge in an open digital society.

ChatGPT and AI Evaluation

From experience, AI is particularly useful at giving big-picture explanations, spotting general trends, and summarising complex subjects in a clear way. For instance, when asking AI to summarise regulatory frameworks, the information was gerenally accurate at a conceptual level and useful as a starting point for further research, but of course it still needed to be followed up with more detailed, in-depth research.

I believe that AI is a valuable tool for supporting learning and professional work, particularly when it is used to complement human expertise rather than replace it. It is most effective in assisting with tasks such as the early stages ofresearch, analysis, and improving efficiency. However, AI has clear limitations. It cannot make ethical decisions, exercise contextual judgement, or understand the law in a normative sense, as its reasoning is based on recognising statistical patterns in data rather than legal principles or values.

A key concern is responsibility, since AI cannot be held accountable for its outputs, even when those outputs influence legal reasoning or decision-making. This limitation is especially significant in legal contexts, where transparency, accountability, and human judgement are essential. For these reasons, professional experience, ethical reasoning, and informed judgement remain indispensable and cannot be replaced by AI.

Self-Evaluation 

Writing about these experiences made the impact of digitalisation more tangible and helped me see how deeply digital tools are already embedded in everyday IP work. It was also a valuable exercise to reflect on data protection in an open digital society. While I was already familiar with GDPR in practice, this reflection highlighted its role as an ongoing responsibility that influences not only compliance, but also how digital systems are designed, implemented, and evaluated over time.

This process helped me connect theory with practice and strengthened my interest in the intersection of digitalisation, Tech law, and innovation. As professional roles continue to evolve, technical literacy, data protection awareness, and a working understanding of AI systems will become increasingly important. In particular, gaining deeper insight into how automated systems are developed, trained, and regulated would improve my ability to identify potential risks, biases, and limitations. More broadly, interdisciplinary knowledge spanning law, technology, and ethics will be essential in navigating future professional environments. Continuous learning, critical thinking, and adaptability will therefore remain key competencies in an increasingly digitalised legal landscape.
